SURVIVORS OF ENVIRONMENTAL DISASTERS: THE LEGAL IMPACTS OF ECOLOGICAL CATASTROPHES IN BRAZIL

Abstract

Brazil faces difficult consequences due to environmental disasters, which not only affect the environment itself but also the life of individuals in the affected regions. The growing frequency of these disasters, such as floods, landslides, and dam ruptures, reveals imperfections in legislation, in the governmental response, and in the performance of the responsible institutions, making urgent the need for legal reforms and more effective public policies to protect the victims. The study proposes an analysis of the legal impacts of these adversities, considering the evolution of environmental laws and the rights of the victims. Furthermore, it addresses the legal challenges faced by the survivors, who often become 'internally displaced' and seek the reconstruction of their lives, demanding financial compensation and psychological support. This article adopts a qualitative, exploratory, and descriptive methodological approach. Emblematic cases from the past ten years were evaluated, such as the heavy rains in Pernambuco in 2022, the dam collapses in Brumadinho and Mariana, and the floods of 2024 in Rio Grande do Sul. Data collection was conducted through a review of legal literature, analysis of environmental legislation, and institutional reports, including those from the National Institute for Space Research (INPE) and the National Center for Monitoring and Early Warning of Natural Disasters (CEMADEN). This study includes an analysis of Brazilian laws, with particular emphasis on Law n° 6.938/1981 and Law n° 14.750/2023.
