Abstract

This study analyzes incarceration in Brazil, especially female incarceration, which has increased significantly, with a 656% increase in the number of women imprisoned between 2000 and 2016. This scenario requires attention to the specific needs of female incarceration, particularly with regard to to motherhood and the impacts on children, since maternal incarceration causes profound family changes, affecting children with maternal absence causing greater social vulnerability, Bill no. 1,151/2023 appears as a proposal to mitigate human rights violations suffered by the children of imprisoned women, extending to them the medical and psychological care provided for in the Child and Adolescent Statute. The objective of this work is to analyze the bill and its implications for protecting the rights of children affected by maternal incarceration. The research seeks to analyze how the proposal can be effective in guaranteeing the human rights of this hyper-vulnerable population. The justification for this study is the need for a specific look at children of imprisoned mothers, aiming to mitigate trauma and promote healthy development. Methodologically, the research is based on bibliographical analysis, with a review of scientific articles and official documents on incarceration in Brazil and around the world, including Bill No. 1,151/2023, in order to evaluate its possible contributions to the protection of children's rights.
