Health regulation: resources in administrative processes of incorporation, exclusion and alteration of health technologies

This article aims to investigate, analyze and present the outcomes of administrative appeals presented before the National Commission for the Incorporation of Technologies ("CONITEC") in the Brazilian National Health System ("SUS"), in procedures for incorporation, exclusion and alteration of technologies in health within the scope of the SUS. The scope of this investigation includes an analysis of the effectiveness of the social right to health from the result of the appeal deliberations with CONITEC. In total, decisions rendered in 22 different administrative processes were analyzed, covering the period from 2012 to 2021. From this analysis, it was possible to conclude that there is room for improvement and improvements in the process in question, in favor of the effectiveness of the social right to health within the scope of CONITEC.
