ACADEMIC SPIN-OFFS IN BRAZIL
LEGAL ANALYSIS AND MULTIPLE CASE STUDY

Universities play an important role in promoting entrepreneurship, noting that a favorable ecosystem is critical for so-called academic spin-offs. Such companies come from ideas and knowledge acquired by the researcher through his activities in the institution to which he is linked, for the purpose of commercializing intellectual property or products derived from his research. This qualitative study analyzed the influence of bureaucracy in public universities, regarding the generation of business resulting from their research. To do so, it enters the space for promoting innovation and entrepreneurship at selected universities. An inductive approach was used to analyze the norms of the Federal Universities of Sergipe (UFS), Minas Gerais (UFMG) and Pernambuco (UFPE). In order to deepen the knowledge about the innovation policy, a case study was carried out with professors guiding the projects selected in the Program for Inducing the Creation of Startups, promoted by UFS, referring to the public notice published in 2021. The concern of the institutions was verified selected with technological innovation and entrepreneurship, having norms linked to business generation. It was possible to recognize a significant legislative advance of the UFS after the publication of its new innovation policy, in 2022, eliminating the legal insecurities of the previous regulation and expanding the opportunities for university entrepreneurship, with a major revision of its organizational structure for innovation and entrepreneurship, which makes its policy more comprehensive than the other selected institutions. It was identified that excellent management needs to be linked to the innovation policy for the advancement of academic entrepreneurship.
