EDUCAÇÃO DOMICILIAR E A (IM) POSSIBILIDADE DE SUA APLICAÇÃO: UMA ANÁLISE DIANTE DO ATUAL CENÁRIO NO BRASIL

This article aims to discuss the definition and practice of home education known as homeschooling, analyzing the current situation in the world and in Brazil, reviewing the legal situation in the country and what the law provides. It will be analyzed whether the theme is legal in terms of the Federal Constitution, the Law of Educational Guidelines and Bases (LDB), the Child and Adolescent Statute (ECA) and the international treaties ratified by Brazil, in addition the agreed changes in education in the midst of the covid-19 pandemic, and whether the regulamentation of homeschooling could improve education in the country. It will seek to discuss what is the right and the position of parents and the State on the topic, what is the role of each in the face of this form of education, and whether this type of education is necessary to meet the educational needs of children without prejudice. The current Brazilian legal situation is still somewhat silent on the subject, with no specific law on homeschooling. A literary review will be carried out, seeking the opinion of scholars of the theme, gathering as sources of research that will provide the theoretical basis for the project and using the analysis of authors, looking for references to make the data analysis. And also, what is the position of the scholars and the Brazilian Federal Supreme Court in relation to homeschooling, for that, will use the deductive method.
