THE GENDER PERSPECTIVE IN LEGAL EDUCATION AND RESOLUTION NO. 5 OF THE NATIONAL EDUCATION COUNCIL

The article aims to analyze the importance of including a gender perspective in Brazilian legal education, in order to enable issues such as stereotypes, discrimination and violence to be studied and debated. A legal education that is exclusively theoretical and technical is no longer sufficient in practice, and it is necessary to have an education in which the critical capacity of legal professionals is developed in relation to the gender inequalities that exist in Brazil. Given this reality, the question arises: how can the inclusion of a gender perspective in Brazilian legal education contribute to the realization of women's human rights? In order to answer this question, two specific objectives were chosen: (i.) to emphasize the importance of including gender studies in legal education curricula in Brazil and (ii.) to analyse Resolution 5 of the National Education Council and the challenges it brings with regard to the national curriculum guidelines for legal education and its purpose. The method applied was the deductive one, as well as the historical procedural method and the techniques of bibliographical and documentary research. In summary, it was concluded that Brazilian legal education has not yet overcome the conservative and androcentric notions of traditional, theoretical and technical education. It is necessary to review the structures, models and methodologies of a patriarchal, chauvinist and sexist culture, which resist essential debates on the subject, and also the inclusion of gender issues in the academic environment, in order to contribute to guaranteeing women's human rights.
